Please read these Terms of Service ("Terms") carefully before using the Farang Guider mobile application ("the App", "Service"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Description of Service

Farang Guider is a mobile application designed to provide informational guidance for immigrants, expatriates, and tourists in Thailand. The App provides:

• Visa type information and general immigration guidance
• Thailand-related news aggregation
• Reminder and notification features for important dates
• Local document storage (document vault)
• Information about official offices, emergency contacts, and customs regulations
• A marketplace directory of verified partner businesses
• Food guide and destination information
• Support for 14 languages

2. Important Disclaimers

2.1 Accuracy of Information

Whilst we strive to provide accurate and up-to-date information, we make no warranties or representations regarding the completeness, accuracy, reliability, or currency of any content in the App. Thai immigration laws, visa requirements, fees, and procedures change frequently. Information in the App may become outdated between updates.

2.2 News Content

News articles displayed in the App are aggregated from third-party sources via the GNews API and RSS feeds. We do not author, verify, or endorse the content of third-party news articles. The inclusion of a news article does not imply our endorsement of its content or source.

2.3 Marketplace Information

Business listings in the Marketplace are provided for informational purposes. Whilst we aim to list reputable businesses, Farang Guider does not guarantee the quality, reliability, legality, or safety of any products or services offered by third-party businesses listed in the App. Any transaction between you and a marketplace business is solely between you and that business.

3. Eligibility

You must be at least 13 years of age (or 16 in the UK, as applicable under the Data Protection Act 2018) to use this App. By using the App, you represent that you meet this requirement.

4. User Responsibilities

As a user of Farang Guider, you agree to:

• Use the App only for lawful purposes and in accordance with these Terms
• Not rely solely on information in the App for immigration, legal, or financial decisions
• Verify all visa and immigration information with official Thai government sources before acting on it
• Be responsible for the security of your device and the data stored in the App
• Not attempt to reverse-engineer, decompile, disassemble, or hack the App
• Not use the App to transmit malware, viruses, or any harmful code
• Not reproduce, distribute, or create derivative works from the App's content
• Comply with all applicable local, national, and international laws whilst using the App

5. Intellectual Property

5.1 Our Rights

The App, including its design, code, graphics, text, logos, icons, images, data compilations, and overall look and feel, is the property of Farang Guider and is protected by copyright, trademark, and other intellectual property laws. The "Farang Guider" name and logo are trademarks of the developer.

5.2 Limited Licence

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on your personal device for personal, non-commercial use, subject to these Terms. This licence does not include the right to:

• Modify, copy, or distribute the App or its content
• Use the App for any commercial purpose without our written consent
• Remove any copyright, trademark, or proprietary notices from the App
• Transfer the licence to another person or "mirror" the App on another server

5.3 Your Content

Any data you create within the App (reminders, document photos, settings) remains your property. We do not claim ownership of your content. Since all user data is stored locally on your device, you retain full control over it.

6. Premium Subscription

Farang Guider offers a premium subscription ("Farang Guider Premium") that unlocks additional features. By subscribing:

• You agree to the pricing and billing terms displayed at the point of purchase
• Subscriptions are billed through Google Play and managed by RevenueCat
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period
• You may cancel at any time via Google Play Store > Subscriptions
• Refunds are subject to Google Play's refund policies
• We reserve the right to modify premium features, though existing subscribers will be notified of material changes

7. Third-Party Services and Links

The App may contain links to third-party websites, services, or resources. These are provided for convenience only. We are not responsible for the content, accuracy, or practices of third-party services. Your use of third-party services is governed by their respective terms and privacy policies.

8. Limitation of Liability

• The App is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
• In no event shall Farang Guider, its developer, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damages arising from:
  • Your use or inability to use the App
  • Any decisions made based on information provided in the App
  • Unauthorised access to your device or data
  • Errors or inaccuracies in visa, immigration, or legal information
  • Actions taken based on marketplace business listings
  • Loss of locally stored data due to device failure, app uninstallation, or other causes
• Our total aggregate liability for all claims arising from or related to the App shall not exceed the amount you paid for the App or premium subscription in the 12 months preceding the claim, or $50 USD, whichever is less.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless Farang Guider and its developer from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Any content you create or store within the App

10. Termination

10.1 By You

You may stop using the App at any time by uninstalling it from your device. This will permanently delete all locally stored data.

10.2 By Us

We reserve the right to suspend or discontinue the App (or any part of it) at any time, with or without notice. We may also restrict your access to premium features if we detect fraudulent activity or violation of these Terms.

10.3 Effect of Termination

Upon termination, your licence to use the App ceases. Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will survive.

11. Modifications to the App and Terms

We reserve the right to:

• Modify, update, or discontinue any features of the App at any time
• Update these Terms at any time by posting the revised version
• Notify users of material changes through the App or via the updated "Last Updated" date

Continued use of the App after changes to the Terms constitutes your acceptance of the updated Terms.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to conflict of law principles. Where applicable, the laws of Thailand may also apply with respect to services and content related to Thailand.

12.2 Dispute Resolution

Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the competent courts of Poland. Nothing in this section limits your rights under mandatory consumer protection laws in your jurisdiction.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Farang Guider regarding the use of the App.
